As a seller in Louisiana, you are required to complete the Louisiana Property Disclosure Form when selling residential real estate. This document helps ensure transparency in the transaction by informing buyers about the property’s condition.
Why Is This Form Important?
Under Louisiana law (LSA-R.S. 9:3196-3200), sellers must disclose known material defects of the property. Buyers have up to 72 hours after receiving the disclosure to cancel their offer without penalty.
How to Complete the Form
- Property Information: Fill in the address and general details of the property.
- Known Defects: Answer questions regarding the condition of the structure, roof, plumbing, electrical systems, foundation, flooding history, and other important details.
- Flood & Insurance Information: Indicate whether the property is in a flood zone and provide any insurance details.
- Exemptions: If applicable, check the appropriate box for exemptions (e.g., newly built homes, estate sales, etc.).
- Sign & Date: Both the seller and buyer must sign the form to acknowledge receipt and understanding.
